Terms of Service

1. Agreement to Terms

By registering an account, accessing, or using the Mithaq platform (“Service”), you enter into a legally binding contract with Mithaq Inc. (“Mithaq,” “we,” or “us”), a corporation organized under the laws of Canada. If you do not agree to these Terms, you must discontinue use immediately.

2. Eligibility & Serious Intent Requirement

Mithaq is explicitly dedicated to intentional marriage matchmaking and is not a casual dating or entertainment application. By using the Service, you represent and warrant that:

• Age of Majority: You are at least 18 years of age (or the legal age of majority in your Canadian province or territory of residence, e.g., 19 in British Columbia, Nova Scotia, New Brunswick, etc.).
• Marital Status: You are legally single, divorced, or widowed, and legally eligible to enter into a marriage contract.
• Sole Purpose: You are creating a profile with sincere and genuine intent to seek a life partner for marriage.
• Criminal Record: You have not been convicted of any indictable offense, violent crime, or sexual crime in Canada or any international jurisdiction.

3. Account Integrity & Identity Accuracy

You agree to provide accurate, current, and authentic information during onboarding and maintain the truthfulness of your profile. Impersonation, catfishing, deceptive representations of marital or professional status, or using unauthorized third-party photographs are strictly prohibited and will result in immediate termination.

4. Code of Conduct & Prohibited Activities

To preserve a safe, respectful, and dignified environment, you agree not to:

• Engage in harassment, stalking, hate speech, defamation, or intimidating behavior toward any member.
• Solicit money, financial assistance, investments, or commercial transactions.
• Circumvent or attempt to disable privacy features, screenshot deterrents, or profile blocking mechanisms.
• Scrape, crawl, or harvest user data through automated scripts or bots.
• Share sexually explicit, obscene, or non-consensual imagery.

5. Safety Disclaimer & Personal Responsibility

While Mithaq enforces verification mechanisms and active moderation, we do not conduct formal criminal background investigations on every registrant. You are solely responsible for exercising prudence, sound judgment, and safe practices when interacting with other members, including conducting conversations in safe environments and verifying personal claims prior to meeting in person.

6. Limitation of Liability & Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF CANADA AND APPLICABLE PROVINCIAL LAWS: THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. MITHAQ MAKES NO GUARANTEES REGARDING MATCH SUCCESS, MARRIAGE COMPATIBILITY, OR CONDUCT OF OTHER USERS. IN NO EVENT SHALL MITHAQ BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM PLATFORM INTERACTIONS.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively within the courts of Toronto, Ontario, Canada.
